Terms of Service

1. Agreement to Terms

By accessing, registering for, or using 8tend ("we", "our", "us") — including the website and mobile app — you agree to be bound by these Terms of Service. If you do not agree, you must not use 8tend. We reserve the right to modify these terms at any time; continued use constitutes acceptance of updated terms.

2. Service Description

8tend is a mobile-first operational visibility platform that helps organisations schedule activities, mark attendance, and keep parents and members informed. Features include:

• Scheduling (recurring + one-off sessions) and staff assignment
• Fast mobile attendance marking
• Real-time parent visibility and a daily activity timeline
• Push-notification and WhatsApp absence alerts, invites, and announcements
• A public organisation profile and communications feed
• Member, group, and parent management

Services are provided "as-is" and may be updated, modified, or discontinued at our sole discretion with reasonable notice.

3. Eligibility & Registration

• You must be at least 18, or act on behalf of a legal entity
• You must have authority to enter a binding agreement
• You must provide accurate, current information at registration
• You must keep your login credentials confidential
• You must notify us of any unauthorised access to your account

You are responsible for all activity that occurs under your account.

4. User Responsibilities

• Use 8tend only for lawful purposes and in line with South African law
• Maintain appropriate security for your credentials
• Obtain all necessary consents before uploading or storing personal information — including for minors
• Ensure your use complies with POPIA
• Report any suspected breach or misuse immediately

5. Acceptable Use Policy

You must not:

• Upload viruses, malware, or malicious code
• Attempt to gain unauthorised access to our systems
• Reverse-engineer or attempt to derive our source code
• Use bots, scrapers, or crawlers without written permission
• Harass, abuse, or threaten other users
• Transmit illegal, obscene, or defamatory content
• Bypass security or access controls
• Use the service for spam, phishing, or fraud
• Resell or sublicense the service without authorisation

6. Intellectual Property Rights

8tend software, design, and associated materials are the exclusive property of SimpleApps (PTY) LTD. You retain all rights to content you create or upload; by uploading it you grant us a non-exclusive, royalty-free licence to store and process that content solely to deliver the service. You may not copy, modify, or distribute our software, or use our trademarks and branding without permission.

7. Subscription & Payment Terms

Plans & billing

• Every organisation begins with a 14-day free trial. After the trial, you choose Community Hosted (free for the organisation; parents pay R29/month per child) or Organisation Hosted (org-paid: R599/mo up to 25 members, R1,499/mo up to 100, R2,999/mo unlimited).
• Organisation Hosted is billed monthly via Paystack.
• Parent subscriptions are billed monthly per child via Paystack.
• Payment must be current to retain premium visibility.

Price changes

We may modify pricing with 30 days' written notice. Continued use constitutes acceptance of new pricing.

Refunds

Subscription fees are non-refundable. No pro-rated refunds are issued on downgrade or cancellation unless required by law. Core attendance and operations remain available on the free Community plan.

8. Limitation of Liability

To the maximum extent permitted by law, 8tend shall not be liable for:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of data, revenue, profits, or business opportunity
• Service interruption or downtime (except where gross negligence is proven)
• Damage caused by third-party services or integrations
• Misuse of the service by users or unauthorised parties

Our total liability shall not exceed the amount you paid for the service in the 12 months preceding the claim. This limitation does not apply to death or personal injury caused by negligence, fraud, or liability that cannot be excluded by law.

9. Indemnification

You agree to indemnify and hold harmless 8tend and SimpleApps (PTY) LTD, its officers, employees, and agents from any claims, damages, losses, or expenses arising from your use of the service in violation of these terms, your violation of any law or third-party right, content you upload, or misuse of your credentials.

10. Service Availability & Support

We strive for high availability but do not guarantee 100% uptime. We are not liable for scheduled maintenance, interruptions beyond our control, or data loss due to user error. Support is provided during standard business hours; priority support is available on Organisation Hosted.

11. Data Ownership & Backup

You retain full ownership of all data you store in 8tend. We maintain automated backups for security and recovery. On account termination, you have 30 days to export your data; after that we permanently delete it. We are not responsible for data loss caused by user error or compromised accounts.

12. Termination

By you

You may terminate at any time by contacting us. Your account is deactivated and data retained for 30 days before permanent deletion.

By 8tend

We may suspend or terminate your account immediately if you violate these terms, engage in illegal or fraudulent activity, fail to pay fees for 30 days after the due date, breach the Acceptable Use Policy, or pose a security risk.

13. Third-Party Services

8tend integrates with third-party services including Paystack (payments), Firebase Cloud Messaging (push notifications), and WhatsApp and email providers (alerts and invites). These are governed by their own terms and privacy policies. You use third-party integrations at your own risk.

14. Amendments to Terms

We may update these terms at any time and will notify you of material changes via email or a prominent notice. Continued use following an update constitutes acceptance.

15. Governing Law

These terms are governed by the laws of South Africa. You consent to the exclusive jurisdiction of the South African courts for any disputes.
